Appeals under the Vegetation Management Act 1999 and the Integrated Planning Act 1997
The Integrated Planning Act 1997 allows landholders to appeal decisions made on their applications to clear vegetation.
Under the vegetation management framework, the department may be involved in assessing applications as either:
- the assessment manager when an application involves only the clearing of native vegetation
- a referral agency when an application involves clearing native vegetation and other assessable development (e.g. material change of use, reconfiguration of a lot, operational works).
If you are unhappy with a decision made by the department, you can appeal to have the decision reviewed. This process will differ depending on whether the department acted as assessment manager or referral agency for the application.
The Vegetation Management Act 1999 also provides for landholders to request an internal review of a decision made where an information notice is received. If, a person is not satisfied with the outcome of the internal review they may apply to the Queensland Civil and Administrative Tribunal (QCAT) for a further review of the decision. This allows a person to obtain a review of a decision by an independent body.
