Data Sharing Licence
This licence provides for the sharing of digital data sets (Licensed Data) between two parties provided there is mutual benefit and a business reason to do so. The creation and distribution of new products is allowed by either party.
Permitted use
- Use the data supplied (Licensed Data) for internal business purposes.
- Combine the Licensed Data with other data to create new products (Licensed Data Products) that will be owned by the creator.
- Allows distribution of Licensed Data Products to third parties.
- Able to provide Licensed Data to consultants to create Licensed Data Products.
Prohibited use
- Cannot distribute Licensed Data to any third party except to a consultant developing a Licensed Data Product or unless allowed for under a Special Conditions clause in the licence. (The department has developed a licence template which can be used to provide Licensed Data to a consultant. This licence template provides minimum terms required to meet the requirements of the Data Sharing Licence.)
- Cannot use the Licensed Data or Licensed Data Products for any form of direct marketing or to infringe privacy. Direct marketing includes but is not limited to using a customer's personal details (eg name, address, email address) in communication with customers by direct mail, telemarketing and electronic mail.
Obligations
- Must not corrupt or introduce any errors into the Licensed Data supplied.
- Must advise the Supplier party of any errors in the Licensed Data when they are identified.
- Must display the appropriate Licensed Data notices required by the Supplier on Licensed Data and Licensed Data Products.
- Must incorporate metadata supplied with the Licensed Data in any Licensed Data Products.
- Must ensure that a subsequent third party distributor of Licensed Data Products displays the copyright notices required and include the metadata supplied with the Licensed Data.
Acquiring data
- Data sets to be included in the data sharing agreement will be negotiated between the two organisations.

Fee structure
Each party will deliver agreed dataset/s at its own cost.
