Online Distributor Licence
This licence allows online distribution of a range of Information Products.
Permitted use
- The Online Distributor may distribute Information Products to third parties.
- In some cases, you may appoint agents as third party distributors of Information Products on your behalf with departmental approval.
Prohibited use
- May not produce reports or publications based on the Information Products for public sale or distribution without prior approval.
- You may not alter the Information Products supplied by the Department.
- Cannot use the Information Products for any form of direct marketing or to infringe privacy. Direct marketing includes but is not limited to using a customer’s personal details (eg name, address, email address) in communication with customers by direct mail, telemarketing and electronic mail.
Obligations
- You must display the relevant copyright notices if not already affixed by the Department on any copies of the Information Products.
- You must make sure that any third party receiving data enters into an agreement with you in accordance with the appropriate terms of the Licence and actively accepts the terms. An example is:
- When a customer seeks to access an Information Product online, the licence conditions are required to be visible on the customer’s computer screen for them to read. The customer must click an “I agree” button before being able to proceed;
- You must keep appropriate records of sales of Information Products to verify relevant fees payable and supply reports on a monthly basis or as required by licence.
Becoming a distributor
- A request for a package of information needs to be made to the contact address below by which the Department assesses if you meet a minimum set of criteria.
- A sample licence is available on the website.
Fee structure
The fees payable are made up of multiple components.
Establishment Fee
Once off fee payable in advance to establish the licence and your connection to the Department.
Access Fee
A monthly fee payable in advance to maintain systems giving access to the specific products.
Information Product Fees
Fees payable monthly in arrears for the products accessed.
