Data Distributor Licence

This licence provides access to digital departmental data (Licensed Data) for distribution in an unchanged form.

Permitted use

Can distribute one or more digital datasets supplied by the department (Licensed Data) to customers.
Can distribute subsets of the Licensed Data supplied by the department to customers.

Prohibited use

Cannot use the Licensed Data supplied by the department to create other products or use the data supplied by the department for its own internal business purposes.
Cannot use the Licensed Data for any form of direct marketing or to infringe privacy. Direct marketing includes but is not limited to using a customer’s personal details (eg name, address, email address) in communication with customers by direct mail, telemarketing and electronic mail.

Obligations

You must display the relevant copyright notices and disclaimer notices provided by the department on any copies of the Licensed Data you distribute.
You must ensure any third party receiving data enters into a written agreement with you in accordance with the Permitted Use Terms for customers provided by the department.
You must keep appropriate records of sales of Licensed Data or subsets of the Licensed Data to verify royalty payments and supply reports on a quarterly basis.

Fee structure

The fees payable are made up of multiple components.

Licence Fee

Annual fee payable in advance to establish licence with the department. Only one licence fee is payable irrespective of how many datasets are required.

Royalty Fee

60% of Recommended Retail Price for each sale of Licensed Data or subset of Licensed Data payable quarterly in arrears.
