Public notification of Chapter 5 draft environmental authorities (mining activities)

In processing environmental authority applications for mining activities, including certain amendment applications, the administering authority in accordance with the Environmental Protection Act 1994 is required to provide an applicant and the mining registrar with a draft environmental authority.

The information in the tables below, lists projects involving Chapter 5 mining activities for which applications for environmental authorities have been made and that are currently undergoing or pending public notification. Projects for which the timeframe for public notification has recently passed are included in the second table.

Draft environmental authorities may be in the process of being uploaded or those being amended or processed may not yet be available. If a draft environmental authority is not currently available for download a copy can be requested by contacting the project manager or regional office as listed for each project.

Requirements for public notification

Under the Environmental Protection Act 1994, it is a requirement that Chapter 5 applications for a mining lease and environmental authority (mining lease or mining claim) and certain amendment applications, undergo a process of public notification.

For applications where public notification is required, the applicant must publish an application notice in the public notices section of the newspaper circulating generally in the area of the relevant land and approved by the Mining Registrar of the Department of Employment, Economic Development and Innovation (DEEDI). Application notices are used to advertise that an application has been made and to advise on the public objection period.

Any person or entity may make an objection about the grant of a mining lease, and/or about the application for the environmental authority, the draft environmental authority for the application or a condition included in the draft environmental authority.

Objections about new applications made pursuant to 211 and 212 of the Environmental Protection Act 1994 and section 252B of the Mineral Resources Act 1989 Act should be made to the Mining Registrar of DEEDI.  

Objections to amendment application notices made pursuant to s254 of the Environmental Protection Act 1994 should be made to DERM.

Objections must be in the approved form (Word, 285K)‡ and be received on or before the last day of the objection period. To make a properly made objection, the objection must:

Step 1 – An application for a new/amendment to an existing environmental authority is lodged.

Step 2 – Draft environmental authority is provided to applicant and mining registrar.

Step 3 – Public notification and objection period.

Step 4 – Referral of current objections to the Land Court.

Step 5 – Application decided.

Mining activities are Chapter 5 activities under the Environmental Protection Act 1994 (Section 146) and require an environmental authority to be issued before the activity can be carried out.

Copies of all current environmental authorities for Chapter 5 activities, including those which were not subject to public notification, can be obtained by contacting the Permit and Licensing Management Unit (PALM) of the Department of Environment and Resource Management by sending a request via email to palm@derm.qld.gov.au.
