Whale watching

General information

Whales are protected under the Nature Conservation Act 1992. The migratory behaviour of whales, and their behaviour of congregating in defined breeding areas, make them susceptible to disruption and interference by whale watching vessels.

A commercial whale watching permit is needed to conduct commercial whale watching activities in Queensland. The law restricts the issuing of commercial whale watching permits in some Queensland waters, and also limits the number of permits that may be issued within certain areas.

The Nature Conservation (Whales and Dolphins) Conservation Plan 1997 specifies minimum approach distances for whales and dolphins by people, vessels, fixed wing aircraft and helicopters. These laws are in place to prevent disruptive behaviour around whales while they are at their most vulnerable.

Pre-design conference service

The department offers a service to guide applicants through the assessment process. The service includes meeting with a departmental project manager to discuss the information that must be provided with your application.

This service can be initiated by contacting the Ecoaccess Customer Service Unit on 1300 368 326 or by email at eco.access@epa.qld.gov.au or completing a Pre-design conference application form. If a meeting is required to discuss your application in more detail, a departmental officer will contact you directly.
