Site investigations / remediation
Land recorded on either register may be required to be investigated and assessed when an application is made for a material change of use or reconfiguration of a lot under the Sustainable Planning Act 2009. More information about the Environmental Protection Act 1994 (EP Act) and the Sustainable Planning Act 2009 (SPA) is available.

In accordance with the EP Act, the department can only accept site investigation reports and validation reports prepared by people who are members of one of the prescribed organisations listed in Schedule 8 of the Environmental Protection Regulation 2008. See the department's information sheet Choosing a contaminated land consultant for a list of prescribed organisations and has qualifications and experience relevant to the site investigation.
The contaminated land consultant performs the work and submits a report about the work to the department. The department reviews the consultant's report. On the basis of the report and any additional work required by the department, the site may be removed from the CLR or EMR, or a site management plan (SMP) can be developed and a suitability statement may be obtained from the department.
